Legal Position

Owning a registered trademark does not give automatic rights or priority to a corresponding domain name. A trademark does not grant ownership over domain names, and multiple parties can legitimately own similar trademarks in different classes or sectors.

Legitimate domain trading is a well-established and legal secondary market in the UK. Buying and selling premium .co.uk domains is normal commercial activity and is protected under UK law.

Nominet DRS Process

In the event that a trademark owner files a complaint under Nominet's Dispute Resolution Service (DRS) against us, we will immediately proceed directly to the Expert Decision stage, bypassing mediation entirely. The Complainant shall pay to Nominet the non-refundable sum of £750 + VAT (£900 inclusive of VAT) in full and in advance in order for the matter to proceed to a full Expert Decision. This fee shall be non-refundable in all circumstances, irrespective of the outcome.

Complainants are strongly advised to satisfy themselves that they are able to bear the full loss of £900 before proceeding, as the decision rests solely and exclusively at the independent expert's absolute discretion and there is no guarantee of success whatsoever.
